These Terms of Service govern your use of the Flamingo Signs website, products, services, quotations, designs, and ordering channels.

Flamingo Signs is a brand owned and operated by FLAMINGO ADS, having its business address at PSR Street, Sullurupeta, Tirupati District, Andhra Pradesh – 524121.

By visiting our website, requesting a quotation, approving a design, making a payment, or placing an order through our website, WhatsApp, email, telephone, social media, or physical store, you agree to these Terms of Service.

In these Terms, “Flamingo Signs,” “FLAMINGO ADS,” “we,” “us,” and “our” refer to FLAMINGO ADS. “Customer,” “you,” and “your” refer to the person or organisation purchasing or using our products or services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to place an order with us.

A person placing an order on behalf of a company, institution, association, or other organisation confirms that they have the authority to accept these Terms on behalf of that organisation.

3. Products and Services

Flamingo Signs provides products and services including, but not limited to:

  • Customized signboards.

  • LED and glow signboards.

  • Acrylic lettering and acrylic products.

  • ACP, WPC, foam-board, sun-board, and vinyl signage.

  • Safety signs and industrial signs.

  • Nameplates and office signs.

  • Printing, cutting, fabrication, and installation services.

  • Customized branding and promotional products.

  • Graphic design and artwork services.

Product availability, specifications, materials, thicknesses, dimensions, colours, lighting, finishing, installation methods, and prices may vary according to the customer’s requirements and the approved quotation.

4. Quotations and Pricing

Prices may be provided through our website, quotation, invoice, WhatsApp, email, telephone, or another authorised communication channel.

Unless otherwise stated:

  • Quotations are valid only for the period mentioned in the quotation.

  • Prices may change due to changes in material costs, measurements, design requirements, delivery location, installation conditions, taxes, or customer-requested modifications.

  • Additional work not included in the approved quotation will be charged separately.

  • Delivery, installation, electrical work, structural work, design work, travel, and taxes may be charged separately unless expressly included.

  • Typographical or calculation errors in a quotation or website listing may be corrected before production begins.

The final price will be based on the specifications approved by the customer.

5. Payments

Customers must make payment according to the payment schedule mentioned in the quotation, invoice, order confirmation, or checkout page.

Depending on the order, we may require:

  • Full advance payment.

  • Partial advance payment.

  • Balance payment before dispatch.

  • Balance payment before or after installation, as agreed in writing.

Production may not begin until the required advance payment is received.

Ownership of the finished product remains with FLAMINGO ADS until the complete order amount and any additional approved charges have been paid.

Customers are responsible for providing correct payment information. Any bank, payment-gateway, transaction, currency-conversion, or chargeback fees may be payable by the customer where applicable.

Cash on delivery is available only when expressly confirmed by Flamingo Signs.

6. Customer Information

Customers must provide complete and accurate information, including:

  • Customer or business name.

  • Billing and delivery address.

  • Mobile number and email address.

  • Product measurements.

  • Required wording and spelling.

  • Logos, photographs, designs, and brand colours.

  • Installation location and site details.

  • GST or invoicing information, where applicable.

Flamingo Signs will not be responsible for delays, incorrect production, failed delivery, or additional expenses caused by incomplete or incorrect information provided by the customer.

7. Design Proof and Customer Approval

For customized orders, a digital design proof may be provided for customer approval.

The customer must carefully check:

  • Names and spelling.

  • Telephone numbers.

  • Addresses and dates.

  • Measurements and quantities.

  • Logos and photographs.

  • Colours and layout.

  • Product material and thickness.

  • Installation and mounting requirements.

  • Any other order specifications.

Approval given through WhatsApp, email, digital message, signature, payment, or another recorded communication will be treated as final approval.

After approval, Flamingo Signs will not be responsible for errors that were visible in the approved design, including spelling mistakes, incorrect numbers, incorrect photographs, layout preferences, or information supplied by the customer.

Changes requested after approval may result in additional charges and production delays.

8. Customer-Provided Content

Customers are responsible for ensuring that they have permission to use all logos, photographs, designs, names, trademarks, text, fonts, artwork, and other content supplied to Flamingo Signs.

By providing content to us, the customer confirms that:

  • The content does not violate another person’s copyright, trademark, privacy, publicity, or other legal rights.

  • The customer has obtained all required permissions and licences.

  • The content is not unlawful, defamatory, obscene, deceptive, or prohibited.

Flamingo Signs may refuse to print, manufacture, or publish content that appears unlawful, offensive, misleading, infringing, or otherwise inappropriate.

The customer will be responsible for claims or losses arising from unauthorised content provided by the customer.

9. Customized and Made-to-Order Products

Most Flamingo Signs products are customized and manufactured according to the customer’s approved specifications.

Customized products cannot normally be cancelled, returned, exchanged, or refunded because of:

  • Change of mind.

  • Incorrect details supplied by the customer.

  • Errors contained in an approved design.

  • Incorrect measurements provided by the customer.

  • A later change in colour, size, material, design, or preference.

  • The product no longer being required.

Customized products may be eligible for review when they are damaged, defective, incorrect, or materially different from the final approved order.

10. Production Variations

Customers acknowledge that minor variations may occur during printing, cutting, fabrication, finishing, and assembly.

Such variations may include:

  • Slight differences in colour between a screen and the finished product.

  • Differences caused by lighting, photography, display settings, printing methods, or material batches.

  • Minor cutting, alignment, thickness, or measurement tolerances.

  • Natural variations in acrylic, metal, wood, vinyl, foam board, paint, lighting, or other materials.

  • Minor marks that do not affect the normal use or overall appearance of the product.

Reasonable production variations will not be considered defects.

11. Production and Delivery Time

Production and delivery estimates are approximate unless a fixed deadline is expressly accepted by Flamingo Signs in writing.

Production time begins only after:

  • Required payment is received.

  • Final design approval is received.

  • Complete order information is provided.

  • Required materials are available.

Delivery or completion may be delayed due to courier delays, material shortages, weather, transport restrictions, power failures, equipment breakdowns, public holidays, strikes, government actions, natural disasters, or other circumstances beyond our reasonable control.

Flamingo Signs will make reasonable efforts to complete orders on time but will not be liable for indirect losses caused by unavoidable delays.

12. Shipping and Delivery

Customers must provide a complete and accurate delivery address.

Once an order has been handed over to a courier or transport provider:

  • Tracking details may be provided where available.

  • Delivery times will depend on the courier or transport provider.

  • The customer must remain available to receive the package.

  • Re-delivery or address-correction charges may be payable by the customer.

  • Flamingo Signs is not responsible for delays caused by incorrect addresses, unavailable recipients, or courier restrictions.

Risk of loss or damage passes according to applicable law and the agreed method of delivery.

13. Delivery Inspection and Unboxing Video

Customers must inspect the package and product immediately after delivery.

A complete, continuous, and unedited unboxing video is mandatory for claims involving:

  • Transportation damage.

  • Manufacturing defects.

  • Incorrect products.

  • Missing products or components.

  • Replacement requests.

  • Return requests.

  • Refund requests.

The video must begin before opening the sealed package and must clearly show:

  • The shipping label.

  • All sides of the sealed package.

  • The complete opening process.

  • The complete product.

  • The reported damage, defect, incorrect item, or missing component.

The customer must contact Flamingo Signs within 24 hours of delivery.

Claims submitted after 24 hours or without a valid unboxing video may not be eligible for a return, replacement, or refund.

All claims are governed by our separate Return and Refund Policy, which forms part of these Terms.

14. Cancellations

Customers must request cancellation before production begins.

Once designing, printing, cutting, fabrication, purchasing of materials, or production has started, cancellation may not be accepted.

When a cancellation is approved, Flamingo Signs may deduct:

  • Design charges.

  • Material costs.

  • Printing and production costs.

  • Payment-gateway charges.

  • Labour costs.

  • Administrative expenses.

  • Other expenses already incurred for the order.

Any remaining approved amount will be refunded according to our Return and Refund Policy.

15. Installation Services

When installation is included, the customer must ensure that:

  • The installation site is accessible and safe.

  • Required permissions have been obtained.

  • Electrical supply and connection points are available.

  • Walls, structures, frames, and mounting surfaces are suitable.

  • The site is ready at the agreed date and time.

  • No concealed wiring, pipes, or structural risks are present.

Additional charges may apply for scaffolding, cranes, elevated work, civil work, electrical work, structural reinforcement, travel, waiting time, repeat visits, or site conditions not disclosed before quotation.

Flamingo Signs is not responsible for damage caused by unsafe structures, unsuitable walls, concealed wiring or pipes, third-party interference, unauthorised relocation, or customer-provided measurements.

16. Product Use and Maintenance

Customers must use, install, clean, and maintain products according to the instructions provided.

Flamingo Signs will not be responsible for damage caused by:

  • Improper installation.

  • Incorrect electrical connections.

  • Voltage fluctuations or power surges.

  • Water exposure where the product is not designed to be waterproof.

  • Strong chemicals or abrasive cleaning.

  • Accidents, misuse, negligence, or vandalism.

  • Unauthorised repairs or modifications.

  • Relocation or reinstallation by another person.

  • Normal wear and tear.

  • Extreme weather or environmental conditions.

17. Warranty

Any warranty applies only when expressly stated in the quotation, invoice, product listing, or written order confirmation.

Unless otherwise stated, a warranty does not cover:

  • Physical or accidental damage.

  • Improper installation or handling.

  • Electrical damage or voltage fluctuation.

  • Water, fire, heat, corrosion, or pest damage.

  • Normal fading, ageing, or wear and tear.

  • Damage caused by third parties.

  • Unauthorised repair, modification, or relocation.

  • Consumable components.

  • Damage occurring after the warranty period.

Warranty service may require photographs, videos, invoice details, and inspection of the product.

18. Intellectual Property

The Flamingo Signs name, FLAMINGO ADS name, website content, product photographs, graphics, logos, templates, layouts, designs, videos, descriptions, and marketing materials belong to FLAMINGO ADS or are used with permission.

They must not be copied, reproduced, modified, resold, distributed, or used commercially without written permission.

Unless expressly agreed in writing:

  • Payment for a finished product does not automatically transfer ownership of editable or source design files.

  • Working files, templates, production files, mock-ups, and design methods remain the property of FLAMINGO ADS.

  • Source or editable files may be provided for an additional charge where available.

Customer-owned logos and content remain the property of the customer or their respective owners.

19. Portfolio and Promotional Use

Unless the customer requests confidentiality in writing before production, Flamingo Signs may photograph or display completed work for:

  • Website portfolios.

  • Social-media pages.

  • Product samples.

  • Catalogues.

  • Advertisements and promotional materials.

Confidential personal information will not intentionally be published as part of such promotional use.

20. Website Use

You agree not to use our website or services:

  • For unlawful or fraudulent purposes.

  • To violate intellectual-property rights.

  • To transmit viruses, malware, or harmful code.

  • To collect information about other users without permission.

  • To interfere with website security or operation.

  • To make false orders, fraudulent payments, or unauthorised chargebacks.

  • To publish abusive, threatening, misleading, or defamatory content.

We may suspend or restrict access to our website or services when these Terms are violated.

21. Third-Party Services

Our website or ordering process may use third-party services such as payment gateways, courier providers, hosting providers, social-media platforms, map services, and communication applications.

These third parties may have their own terms and privacy policies. Flamingo Signs is not responsible for the availability, actions, policies, or independent services of third-party providers.

22. Product Information and Website Errors

We make reasonable efforts to ensure that product descriptions, photographs, prices, availability, and specifications are accurate.

However:

  • Photographs may be for illustration purposes.

  • Screen colours may differ from actual product colours.

  • Prices or descriptions may contain typographical errors.

  • Products or materials may be changed or discontinued.

  • Website availability may occasionally be interrupted.

We may correct errors, update information, or cancel an affected order. When an order is cancelled because of our pricing or listing error, any amount received for that cancelled order will be refunded.

23. Limitation of Liability

To the extent permitted by applicable law, Flamingo Signs will not be liable for indirect, incidental, special, or consequential losses, including loss of profits, business, opportunity, data, reputation, or anticipated savings.

Where liability cannot legally be excluded, our total liability relating to a particular order will generally be limited to the amount paid by the customer for the affected product or service.

Nothing in these Terms excludes liability or customer rights that cannot legally be excluded under applicable law.

24. Indemnification

You agree to compensate FLAMINGO ADS for reasonable losses, claims, expenses, or legal liabilities arising from:

  • Your violation of these Terms.

  • Unlawful content provided by you.

  • Your infringement of another person’s intellectual-property or privacy rights.

  • Fraudulent or unauthorised use of our services.

  • Improper installation, use, modification, or resale of our products.

This provision applies only to the extent permitted by applicable law.

25. Privacy

Personal information collected during enquiries, quotations, payments, production, delivery, and customer support will be handled according to our Privacy Policy and applicable law.

By providing your telephone number, email address, or WhatsApp number, you consent to receive order-related communications, including quotations, design proofs, invoices, payment updates, production updates, and delivery information.

Promotional communications may be stopped by contacting us.

27. Governing Law and Dispute Resolution

These Terms are governed by the laws of India.

The parties should first attempt to resolve any dispute through direct communication and good-faith negotiation.

Subject to applicable consumer-protection laws and any jurisdiction that cannot legally be excluded, disputes will be subject to the jurisdiction of the competent courts and authorities serving Sullurupeta or Tirupati District, Andhra Pradesh.

Nothing in these Terms prevents a consumer from approaching an appropriate consumer commission or exercising any statutory right available under applicable law.

28. Changes to These Terms

We may update these Terms from time to time to reflect changes in our products, services, business practices, or legal requirements.

Updated Terms will be published on our website with a revised effective date. Changes will apply to orders placed after the updated Terms become effective unless otherwise required by law.

29. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

30. No Waiver

Failure by Flamingo Signs to enforce any provision of these Terms on one occasion does not waive the right to enforce that provision later.

31. Entire Agreement

These Terms, together with the approved quotation, invoice, design approval, Return and Refund Policy, Privacy Policy, shipping terms, and written order confirmation, constitute the agreement between the customer and FLAMINGO ADS.

Where there is a conflict, the specific written quotation or order agreement will apply to that order, subject to applicable law.
